EPA Revises Antimicrobial Pesticide Data Requirements Guidance

U.S. EPA announced it is making available a revised Antimicrobial Pesticide Use Site Index (USI), which simplifies and improves the agency’s guidance to assist applicants for antimicrobial pesticide registration.

The new USI helps applicants identify the data requirements necessary to register a pesticide or support their product registrations and will likewise be used by EPA staff evaluating pesticide applications. This document provides guidance about antimicrobial pesticide use sites and general antimicrobial pesticide use patterns and helps registrants determine if labeled uses require the establishment of a tolerance (maximum residue level for food or feed) or exemption from the requirement of a tolerance.

Based on the comments, a number of changes have been made including:
• simplifying the USI by organizing example use sites into broader groups;
• making the USI easier to follow by using a tabular format for examples of use sites, organized by food use description (i.e., direct food use, indirect food use, and nonfood use) within each major use pattern category;
• deleting from the USI some example use sites that were too ambiguous, too vague, too specific, or incorrectly categorized regarding major use pattern category or food use description; and incorporating revised examples of use sites into the material preservatives and wood preservatives use pattern categories.

The revised guidance complements EPA’s 2013 amendments to the data requirements for antimicrobial pesticides. The publication of this the revised Use Site Index guidance satisfies a condition of the March 2, 2015, settlement agreement between EPA and the American Chemistry Council, which followed their legal challenge of the data requirements.
