Indian Pesticide Manufacturers Win 3-Year Court Battle

A decision from India’s Supreme Court puts an end to guidelines from the Central Insecticide Board & Registration Committee (CIB&RC), which gave foreign importers of pesticides an advantage over domestic manufacturers.

The Pesticides Manufacturers & Formulators Association of India (PMFAI) and other members of India’s crop protection industry called the decision “a great relief to farmers all over India to get pesticides at a reasonable price, breaking monopolies of importers of ready-made pesticide formulations and is also success to Indian pesticide industry.”

The court saga began in September 2013 when the CIB&RC implemented guidelines allowing registrations for “imports of ready-made pesticide formulations without registering its technical grade pesticide (active ingredient) in India,” a requirement for domestic manufacturers. That triggered a series of court decisions which alternately allowed and prevented those registrations.

The latest ruling from the Supreme Court ends that back and forth prevents those registrations effectively giving India’s domestic manufacturers equal footing with foreign importers.

“The biggest beneficiary of above decision of Supreme Court of India will be Indian farmers, as they will get locally manufactured pesticides from the Indian pesticide industry at half of the price against the imported products,” said PMFAI.
