Los derechos de propiedad intelectual (DPI), en forma de patentes y protecci\u00f3n de datos para registros, son de fundamental importancia para la din\u00e1mica de la industria agroqu\u00edmica y dictan el equilibrio entre el sector de I + D (empresas innovadoras) y el sector gen\u00e9rico.<\/p>\n<p>Hay aproximadamente 500 ingredientes activos agroqu\u00edmicos fabricados a partir de s\u00edntesis org\u00e1nica que representan m\u00e1s del 90% del mercado total. Durante los \u00faltimos 15 a\u00f1os, la innovaci\u00f3n agroqu\u00edmica ha disminuido y ahora solo se introducen en el mercado de cuatro a ocho nuevos IA cada a\u00f1o. Sin embargo, ha habido un aumento significativo en el n\u00famero de nuevos productos que llegan al mercado principalmente como resultado de productos mezclados. La mayor\u00eda de las nuevas solicitudes de patentes para productos agroqu\u00edmicos no son para el descubrimiento de nuevos IA, sino para patentes secundarias como mezclas, formulaciones y procesos.<\/p>\n<p>Estos productos mezclados y nuevas formulaciones tambi\u00e9n pueden recibir protecci\u00f3n mediante patente, lo que ha dado como resultado una segmentaci\u00f3n significativa del mercado y protecci\u00f3n frente a la competencia gen\u00e9rica. Los productos de mezcla se desarrollan por una serie de razones t\u00e9cnicas que incluyen:<br \/>\n\u2022 Manejo de resistencias y resistencias<br \/>\n\u2022 Los IA m\u00e1s nuevos tienden a tener un espectro de actividad m\u00e1s estrecho en comparaci\u00f3n con los productos m\u00e1s antiguos y, por lo tanto, se requiere mezclarlos con otros IA de diferente modo de actividad para proporcionar un espectro de control completo, especialmente fungicidas.<\/p>\n<p>El an\u00e1lisis de IA en patente en la base de datos AgriBase de Enigma Marketing Research (EMR) muestra que los herbicidas tienen en promedio la mayor cantidad de productos de mezcla (5-6 por IA), seguidos de fungicidas (4-5 por IA) y luego insecticidas (1- 2 por IA). Es interesante notar que en el caso de los insecticidas, la oportunidad de segmentar el mercado a trav\u00e9s de mezclas es m\u00e1s limitada, por lo que el mercado es m\u00e1s vulnerable a la competencia de gen\u00e9ricos y, como resultado, los litigios sobre patentes de insecticidas han tendido a ser sobre patentes de proceso.<\/p>\n<p>Los productos de mezcla tambi\u00e9n brindan a la empresa originaria una mayor protecci\u00f3n contra la competencia de gen\u00e9ricos como:<\/p>\n<p>\u2022 Las mezclas segmentan el mercado y crean una mayor cantidad de productos de marca, lo que dificulta que los gen\u00e9ricos tomen<br \/>\ncuota de mercado.<br \/>\n\u2022 Muchos productos de mezcla contienen otros ingredientes activos protegidos por patente.<br \/>\n\u2022 Muchos productos de mezclas han recibido protecci\u00f3n de patente por derecho propio como resultado de la denominada actividad sin\u00e9rgica.<\/p>\n<p>Desde 2000, EMR ha publicado una serie de ocho informes titulados &quot;Nuevos agroqu\u00edmicos gen\u00e9ricos \/ sin patente&quot;. Estos informes han identificado y perfilado m\u00e1s de 180 IA comerciales importantes en un momento en el que la protecci\u00f3n de patente b\u00e1sica estaba a punto de expirar. En el \u00faltimo informe, EMR tambi\u00e9n identifica productos de mezcla protegidos por patente.<\/p>\n<p>Para aquellas empresas que planean ingresar al mercado europeo, existe una complicaci\u00f3n adicional de la extensi\u00f3n del plazo de la patente o los Certificados de Protecci\u00f3n Suplementaria (SPC). Los CCP se introdujeron en 1993 para los productos farmac\u00e9uticos cuando la UE reconoci\u00f3 que exist\u00eda una erosi\u00f3n significativa en el plazo efectivo de la patente para los productos farmac\u00e9uticos, lo que result\u00f3 en un per\u00edodo de exclusividad de mercado insuficiente para recuperar los sustanciales costos de I + D. En 1997, como resultado de la intensa presi\u00f3n ejercida por el sector de I + D de agroqu\u00edmicos, se introdujeron SPC para agroqu\u00edmicos.<\/p>\n<p>Los CCP prolongan la vida \u00fatil de una patente hasta un m\u00e1ximo de cinco a\u00f1os y se otorgan en Europa a nivel nacional. Cualquier empresa que planee ingresar al mercado de la UE debe establecer cu\u00e1ndo expiraron las patentes para la IA, los productos de mezcla u otras patentes secundarias, si se otorgaron SPC y si han expirado ahora.<\/p>\n<p>Para ampliar sus servicios, EMR ha adquirido los derechos globales del Cabinet Alice de Pastors (CAP) para una base de datos que identifica SPC para agroqu\u00edmicos. Para ambas IA, el plazo est\u00e1ndar de la patente de 20 a\u00f1os expira en 2015, pero en la UE, los RCP est\u00e1n en vigor en algunos pa\u00edses y extienden la protecci\u00f3n mucho m\u00e1s all\u00e1 de este plazo (ver Figura 1).<\/p>\n<p>&nbsp;<\/p>\n<p>El protioconazol es un fungicida de triazolintiona descubierto y desarrollado por Bayer CropScience para su uso como spray foliar en cereales (trigo, cebada y centeno), colza \/ canola, man\u00ed, legumbres, soja, arroz, remolacha azucarera y hortalizas cultivadas en el campo.
