El contenido de carbono del suelo est\u00e1 disminuyendo por varias razones, pero las Directivas marco sobre nitratos, emisiones y agua tambi\u00e9n desempe\u00f1an un papel importante.<\/p>\n<p>Se puede aumentar el contenido de carbono del suelo mediante el uso de materiales fertilizantes con alto contenido de materia org\u00e1nica. Dichos materiales proceden en particular de esti\u00e9rcol animal y materiales fertilizantes org\u00e1nicos. Sin embargo, estos materiales a menudo contienen una mezcla de oligoelementos desfavorables, dependiendo de la fuente de pat\u00f3genos humanos, as\u00ed como nutrientes beneficiosos. Todos ellos est\u00e1n regulados por diversas legislaciones a nivel horizontal de la UE y, adem\u00e1s, a nivel nacional y, a veces, incluso regional.<\/p>\n<p>Tres puntos sugieren que las legislaciones obstaculizan un aumento razonable del carbono del suelo debido a mesetas nutritivas o los llamados techos, por ejemplo, techo N, techo P y techos para oligoelementos como Cu y Zn.<\/p>\n<p>Repensando el mundo regulatorio y tomando el secuestro de carbono como un objetivo principal para mantener un suelo saludable para la pr\u00f3xima generaci\u00f3n, se sugiere agregar un nuevo tipo de fertilizante al Reglamento de Productos Fertilizantes de la UE (UE) 2019\/1009 (FPR).<\/p>\n<p>El FPR regula los fertilizantes inorg\u00e1nicos y es un intento importante de regular tambi\u00e9n los fertilizantes org\u00e1nicos. Desde mediados de julio de 2022, los fertilizantes org\u00e1nicos se pueden vender en toda la Uni\u00f3n Europea si cumplen con los requisitos de FPR y llevan la marca CE. Los Estados miembros de la UE no restringir\u00e1n los fertilizantes que lleven la marca CE. Los fertilizantes org\u00e1nicos s\u00f3lidos deben contener un m\u00ednimo de materia org\u00e1nica 27% de acuerdo con FPR (Tabla 1). En base a esto, ser\u00eda necesario esparcir m\u00faltiples cantidades (por ejemplo,&gt; 100 t \/ ha en teor\u00eda) de fertilizante org\u00e1nico fresco. \u00bfPermiten las legislaciones de la UE, as\u00ed como el FPR, cantidades tan enormes para las mediciones de correcci\u00f3n que podr\u00edan aumentar seriamente el contenido de materia org\u00e1nica y apoyar el secuestro de carbono del suelo?<\/p>\n<p>La conferencia LATAM de <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:31991L0676&amp;from=EN\" target=\"_blank\" rel=\"noopener\">Directiva de nitratos (UE) 91\/676 (ND)<\/a> introdujo un l\u00edmite de concentraci\u00f3n de nitrato de 50 mg \/ L para aguas subterr\u00e1neas y superficiales. Este l\u00edmite se implementa en varias leyes nacionales, planes de acci\u00f3n obligatorios y se convierte en l\u00edmites m\u00e1ximos de aplicaci\u00f3n de fertilizantes que dirigen (o restringen) la gesti\u00f3n de las explotaciones por parte de cada estado miembro. Por ejemplo, los techos de aplicaci\u00f3n de N se establecen por cultivo y por tipo de suelo durante la temporada de crecimiento en:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.rvo.nl\/sites\/default\/files\/2020\/02\/Tabel-2-Stikstof-landbouwgrond-2019-2021.pdf\" target=\"_blank\" rel=\"noopener\">Los pa\u00edses bajos<\/a> (p. ej. patatas de consumo: 96 - 275 Kg N \/ ha o trigo de invierno 160 - 245 Kg N \/ ha)<\/li>\n<li><a href=\"https:\/\/www.vlm.be\/nl\/SiteCollectionDocuments\/Publicaties\/mestbank\/Bemestingsnormen_2021.pdf\" target=\"_blank\" rel=\"noopener\">B\u00e9lgica<\/a> (p. ej. patatas: 163 - 200 Kg N \/ ha o trigo de invierno 136 - 175 Kg N \/ ha).<\/li>\n<\/ul>\n<p>Adem\u00e1s, se fij\u00f3 un l\u00edmite m\u00e1ximo para el abono animal y los productos procesados en 170 Kg N \/ ha. Desde entonces, los agricultores comenzaron a utilizar los techos m\u00e1ximos de nitr\u00f3geno para alimentar el cultivo que necesitaba absolutamente el N para maximizar el rendimiento y prevenir las deficiencias de los cultivos. La legislaci\u00f3n ya no les permiti\u00f3 ocuparse del contenido de materia org\u00e1nica o del secuestro de carbono en sus suelos.<\/p>\n<p>En las zonas con ganader\u00eda muy intensiva se introdujeron techos nacionales de fosfato en la legislaci\u00f3n a nivel regional. En los Pa\u00edses Bajos, B\u00e9lgica y otros pa\u00edses, se establecieron techos de fosfato para evitar la lixiviaci\u00f3n a las aguas subterr\u00e1neas y superficiales y se tradujeron en tasas de aplicaci\u00f3n m\u00e1ximas. Por ejemplo, techos de aplicaci\u00f3n para fosfato:<\/p>\n<ul>\n<li>en <a href=\"https:\/\/www.rvo.nl\/onderwerpen\/agrarisch-ondernemen\/mest\/gebruiken-en-uitrijden\/hoeveel-fosfaat-landbouwgrond\/fosfaatdifferentiatie\" target=\"_blank\" rel=\"noopener\">Los pa\u00edses bajos<\/a> se fijan entre 40 - 120 Kg P<sub>2<\/sub>O<sub>5<\/sub> \/ ha para cultivos herb\u00e1ceos dependiendo del contenido de P en el suelo despu\u00e9s del muestreo;<\/li>\n<li>y en <a href=\"https:\/\/www.vlm.be\/nl\/SiteCollectionDocuments\/Publicaties\/mestbank\/Bemestingsnormen_2021.pdf\" target=\"_blank\" rel=\"noopener\">B\u00e9lgica<\/a> para patatas y trigo de invierno: 55 - 95 Kg P<sub>2<\/sub>O<sub>5<\/sub> \/ ha.<\/li>\n<\/ul>\n<p>Sin embargo, desde que se implementaron estos techos regionales, los agricultores comenzaron a usar el techo P para alimentar el cultivo que necesitaba absolutamente el P para maximizar el rendimiento y prevenir las deficiencias de los cultivos. Tambi\u00e9n aqu\u00ed, la legislaci\u00f3n no permit\u00eda a los agricultores cuidar el contenido de materia org\u00e1nica o el secuestro de carbono en sus suelos.<\/p>\n<p>Otra fuente org\u00e1nica proviene de las plantas de tratamiento de aguas residuales que producen lodos de depuradora. El <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:31986L0278&amp;from=EN\" target=\"_blank\" rel=\"noopener\">Directiva sobre lodos de depuradora (UE) 86\/287 (SSD)<\/a> se encuentra actualmente en revisi\u00f3n. En Francia, los lodos de depuradora se colocan en tierras de cultivo para aumentar la materia org\u00e1nica y aprovechar los nutrientes disponibles para el suelo bas\u00e1ndose, por ejemplo, en un plan de fertilizaci\u00f3n acordado con el local. <a href=\"https:\/\/grandest.chambre-agriculture.fr\/agro-environnement\/valorisation-agricole-des-produits-organiques-et-mineraux-dorigines-urbaines-et-industrielles\/boues-industrielles\/\" target=\"_blank\" rel=\"noopener\">c\u00e1mara de agricultura<\/a>. La legislaci\u00f3n sobre residuos combinada con el SSD estableci\u00f3 l\u00edmites para los microelementos y trazas. Sin embargo, mientras que en un pa\u00eds el Cu (de las tuber\u00edas de agua) y el Zn (de las canaletas de los techos y los sistemas de alcantarillado) se consideran micronutrientes beneficiosos, en otros pa\u00edses se consideran metales pesados y, por lo tanto, no pueden aplicarse.<\/p>\n<p>Estos tres puntos sugieren que la legislaci\u00f3n de la UE y sus Estados miembros obstaculiza un aumento razonable del carbono del suelo debido a los l\u00edmites m\u00e1ximos establecidos para los macronutrientes (N y P) y los micronutrientes (Cu y Zn). Se puede decir que el FPR es una legislaci\u00f3n facultativa, lo que significa que el cumplimiento de este requisito horizontal ocurre de forma voluntaria. Sin embargo, desde una perspectiva legal, otras legislaciones de emisiones derivadas de la horizontal y traducidas a la legislaci\u00f3n nacional con el establecimiento de l\u00edmites m\u00e1ximos adicionales para las aplicaciones de nutrientes y oligoelementos convierten los requisitos de opcionales a obligatorios.<\/p>\n<p>La fertilizaci\u00f3n org\u00e1nica a granel de alrededor de 50 toneladas de materia org\u00e1nica (por ejemplo,&gt; 100 t \/ ha de producto fresco) para aumentar el secuestro de carbono no ser\u00e1 posible en muchos pa\u00edses porque esto resultar\u00eda en exceder el techo de N, el techo de P, el techo de nutrientes, o techos para otros oligoelementos.<\/p>\n<p>Repensar el marco regulatorio y tomar en cuenta el secuestro de carbono como un objetivo principal para mantener un suelo saludable para la pr\u00f3xima generaci\u00f3n podr\u00eda requerir la inclusi\u00f3n de un nuevo tipo de fertilizante en el FPR definido como: Secuestro de
