Ser\u00e1 t\u00e3o bem-sucedida que a subst\u00e2ncia ativa (AS) fora de patente nunca se tornar\u00e1 um verdadeiro produto gen\u00e9rico? Quais s\u00e3o as dificuldades enfrentadas por um fabricante de gen\u00e9ricos para colocar um gen\u00e9rico no mercado?<\/p>\n<p>Um fabricante gen\u00e9rico tem que navegar por um campo minado antes de poder abrir o port\u00e3o para o mercado. Em seu caminho est\u00e3o quatro estrat\u00e9gias de defesa principais usadas por empresas inventoras para proteger um mercado ap\u00f3s o vencimento do AS:<br \/> <strong>\u2022 Segmenta\u00e7\u00e3o de mercado <br \/> \u2022 S\u00edntese\/tecnologia\/know-how de fabrica\u00e7\u00e3o<br \/> \u2022 Registos \u2014 protec\u00e7\u00e3o de dados<br \/> \u2022 Direitos de Propriedade Intelectual (DPI)<\/strong><\/p>\n<p>Descoberto e desenvolvido pelo ICI (agora <a href=\"http:\/\/www.syngenta.com\/\" target=\"_blank\">Syngenta<\/a>), o fungicida de amplo espectro azoxistrobina se tornou o fungicida AS mais vendido no mundo, com vendas de mais de $1 bilh\u00e3o. Foi o primeiro da classe de produtos de estrobilurina de grande sucesso a ser comercializado.<\/p>\n<p>O sucesso da azoxistrobina \u00e9 baseado em sua capacidade de prevenir e\/ou curar todos os quatro principais grupos de fungos patog\u00eanicos de plantas: Ascomcetes, Basidiomicetos, Deutoromicetos e Oomicetos, que causam doen\u00e7as transmitidas pelo solo e foliares, como ferrugens, o\u00eddio, m\u00edldio, podrid\u00e3o negra, sarna, antracnose, mofo branco, <em>Rhizoctonia<\/em> podrid\u00e3o dos galhos, podrid\u00e3o do pino, mancha foliar precoce e tardia, sigatoka negra, podrid\u00e3o cinzenta, mancha-da-mata e brusone do arroz.<\/p>\n<p>Essa ampla gama de atividades foi traduzida por meio de extenso desenvolvimento e testes em produtos registrados em cerca de 100 pa\u00edses. Eles s\u00e3o usados em mais de 120 culturas, como trigo, uvas, frutas c\u00edtricas, girass\u00f3is, morangos, cebolas, algod\u00e3o, nozes pecan, p\u00eassegos, canola, milho, soja, arroz, br\u00e1ssicas, cucurbit\u00e1ceas, bananas, batatas, amendoins, grama e plantas ornamentais.<\/p>\n<p>A descoberta da azoxistrobina resultou de uma combina\u00e7\u00e3o de engenhosidade da natureza, habilidades cient\u00edficas e determina\u00e7\u00e3o. A classe de fungicidas estrobilurinas foi descoberta nas d\u00e9cadas de 1960 e 1970 ap\u00f3s o isolamento e caracteriza\u00e7\u00e3o de compostos fungicidas que s\u00e3o naturalmente produzidos por algumas esp\u00e9cies de <em>Basidiomiceto<\/em> fungos. Esses compostos demonstraram ter um novo modo de a\u00e7\u00e3o, mas n\u00e3o eram candidatos adequados para serem produtos fungicidas comerciais porque s\u00e3o inst\u00e1veis \u00e0 luz solar. Usando t\u00e9cnicas como conhecimento da rela\u00e7\u00e3o estrutura-atividade, os qu\u00edmicos sintetizaram an\u00e1logos dos produtos naturais para descobrir compostos com propriedades fungicidas e estabilidade superiores. A ICI entrou com o primeiro pedido de patentes para estrobilurinas em 1984 e sintetizou cerca de 1.400 mol\u00e9culas em sua busca pela azoxistrobina, que se tornou a primeira estrobilurina a ser comercializada em 1996. No final da d\u00e9cada de 1980, tr\u00eas estrobilurinas \u2014 azoxistrobina (ICI), trifloxistrobina (Ciba Geigy agora Syngenta) e cresoxim-metil (<a href=\"http:\/\/www.basf.com\/\" target=\"_blank\">BASF<\/a>) \u2014 estavam em desenvolvimento.<\/p>\n<p>A azoxistrobina \u00e9 comercializada pela Syngenta como produtos AS individuais sob v\u00e1rios nomes comerciais, sendo os principais para prote\u00e7\u00e3o de culturas: Amistar, Abound, Priori, Quadris, Dynasty para tratamento de sementes e Heritage para gramados.<\/p>\n<p>Apesar do lan\u00e7amento de outros produtos de estrobilurina e do crescimento da resist\u00eancia \u00e0 estrobilurina, especialmente em cereais na Europa, onde as vendas de fungicidas de estrobilurina ca\u00edram de 2002 a 2008, a azoxistrobina conseguiu continuar a crescer por meio da expans\u00e3o para novos pa\u00edses, novas culturas (em 2010, a Syngenta obteve aprova\u00e7\u00e3o para a azoxistrobina como Priori Xtra para uso em cana-de-a\u00e7\u00facar) e especialmente por meio do desenvolvimento de produtos mistos.<\/p>\n<p>Azoxystrobin \u00e9 fabricado na unidade da Syngenta em Grangemouth, Reino Unido, que entrou em opera\u00e7\u00e3o em agosto de 1996. O investimento original na instala\u00e7\u00e3o foi de $23,8 milh\u00f5es, e tinha uma capacidade de 1.500 tpa como AS. Precisamos olhar para o campo minado para verificar onde existem as principais barreiras. Patentes e quest\u00f5es de prote\u00e7\u00e3o de dados precisam ser examinadas em detalhes em todos os mercados nacionais e regionais.<\/p>\n<p>A UE reconheceu que uma eros\u00e3o significativa no prazo efetivo de patentes existia para produtos farmac\u00eauticos e isso resultou em um per\u00edodo de exclusividade de mercado insuficiente para recuperar os custos substanciais de P&amp;D e, como resultado, os Certificados de Prote\u00e7\u00e3o Suplementar (SPCs) foram introduzidos em 1992. Os SPCs d\u00e3o at\u00e9 cinco anos de prote\u00e7\u00e3o de patente adicional ao prazo normal de 20 anos. Como resultado de um amplo lobby pelo setor de P&amp;D agroqu\u00edmico, os SPCs se tornaram lei para agroqu\u00edmicos em 1996.<\/p>\n<p>Na UE, a azoxistrobina \u00e9 protegida pelo EP0382375, que expirou em janeiro de 2010. No entanto, em v\u00e1rios pa\u00edses da UE, os SPCs foram concedidos e expirar\u00e3o durante 2011. A azoxistrobina ganhou inclus\u00e3o no Anexo I como um novo AS sob a Diretiva da UE 91\/414\/EEC em julho de 1998 e, portanto, os 10 anos de prote\u00e7\u00e3o de dados agora expiraram.<\/p>\n<p>A linha do tempo mostra o per\u00edodo de exclusividade de mercado na UE para produtos baseados em AS \u00fanico azoxistrobina. A partir da linha do tempo, pode-se ver que o mercado na UE em breve estar\u00e1 aberto \u00e0 concorr\u00eancia gen\u00e9rica.
