Este artigo examinar\u00e1 \u00e1reas onde empresas n\u00e3o-inventoras precisam melhorar sua base de conhecimento para capitalizar neste cen\u00e1rio de mercado em constante melhoria.<\/p>\n<p>Existem basicamente dois tipos de empresas n\u00e3o inventoras:<br \/>\n\u25a0 Empresas de marketing \u2013 tendem a ser nacionais ou regionais, investem em registros, compram ingredientes ativos ou produtos acabados formulados e vendem na rede de distribui\u00e7\u00e3o local. O Diagrama 1 analisa o processo total de levar um gen\u00e9rico ao mercado e identifica a \u201clacuna de conhecimento\u201d que existe entre os dois tipos de empresa. Ambas n\u00e3o t\u00eam conhecimento profundo das atividades uma da outra, o que potencialmente leva ao desenvolvimento desarticulado do produto e a relacionamentos ruins.<\/p>\n<p>A \u201clacuna de conhecimento\u201d abrange muitas \u00e1reas complexas diferentes que exigem experi\u00eancia em, por exemplo, patentes, extens\u00f5es de prazo de patentes, requisitos de registro, prote\u00e7\u00e3o de dados, qu\u00edmica de processos, perfis de impurezas e qu\u00edmica anal\u00edtica, e controle de qualidade de ingrediente ativo e\/ou produto acabado.<\/p>\n<p>O primeiro passo em qualquer desenvolvimento de produto \u00e9 identificar o produto ou ingrediente ativo, e tanto as empresas de marketing quanto as de fabrica\u00e7\u00e3o fazem isso, mas de perspectivas diferentes \u2013 a empresa de marketing \u00e9 liderada pelo mercado, enquanto a empresa de fabrica\u00e7\u00e3o \u00e9 orientada pela tecnologia. Identificar o ingrediente ativo a ser desenvolvido \u00e9, em si, um processo complexo, pois h\u00e1 muitos m\u00e9todos para escolher.<\/p>\n<p>Desde 2000, a Enigma Marketing Research publicou uma s\u00e9rie de sete relat\u00f3rios intitulada \u201cNovos agroqu\u00edmicos gen\u00e9ricos\/sem patente\u201d. Esses relat\u00f3rios identificaram e tra\u00e7aram o perfil de mais de 160 principais ingredientes ativos comerciais que em breve perder\u00e3o a prote\u00e7\u00e3o b\u00e1sica de patente.<\/p>\n<p>Al\u00e9m da patente b\u00e1sica que protege a mol\u00e9cula <em>por si s\u00f3,<\/em> empresas inovadoras criam um portf\u00f3lio de patentes para tentar proteger o mercado quando a patente do ingrediente ativo b\u00e1sico expira \u2013 \u00e9 essencial, portanto, que o fabricante gen\u00e9rico verifique se pode haver outras patentes cobrindo:<br \/>\n\u25a0 formula\u00e7\u00f5es inovadoras<br \/>\n\u25a0 misturas sin\u00e9rgicas de ativos<br \/>\ningredientes<br \/>\n\u25a0 m\u00e9todos de fabrica\u00e7\u00e3o<br \/>\n\u25a0 principais intermedi\u00e1rios<br \/>\n\u25a0 resolu\u00e7\u00e3o de uma mistura rac\u00eamica para<br \/>\no is\u00f4mero opticamente ativo<\/p>\n<p>Muitas patentes de mistura foram concedidas nos \u00faltimos 10 a 15 anos e, al\u00e9m dos benef\u00edcios t\u00e9cnicos dos produtos de mistura, tamb\u00e9m resultam benef\u00edcios comerciais. Tamb\u00e9m \u00e9 usado como tratamento de sementes (nomes comerciais: Redigo, Lamardor, Raxil e Proceed).<\/p>\n<p>Foi lan\u00e7ado pela primeira vez em 2005 e, em 2014, o protioconazol era comercializado em muitos pa\u00edses, incluindo: Argentina, Austr\u00e1lia, \u00c1ustria, B\u00e9lgica, Bielorr\u00fassia, Brasil, Bulg\u00e1ria, Canad\u00e1, Rep\u00fablica Tcheca, Dinamarca, Est\u00f4nia, Finl\u00e2ndia, Fran\u00e7a, Alemanha, Hungria, Irlanda, It\u00e1lia, Let\u00f4nia, Litu\u00e2nia, Holanda, Nova Zel\u00e2ndia, Pol\u00f4nia, Rom\u00eania, R\u00fassia, Ar\u00e1bia Saudita, Eslov\u00e1quia, Eslov\u00eania, Su\u00e9cia, Turquia, Ucr\u00e2nia, Reino Unido e EUA.<\/p>\n<p>O mercado europeu \u00e9 particularmente importante e o protioconazol \u00e9 misturado com muitos outros ativos, incluindo:<br \/>\n\u25a0 bixafen<br \/>\n\u25a0 bixafeno + fluoxastrobina<br \/>\n\u25a0 bixafeno + espiroxamina<br \/>\n\u25a0 bixafeno + tebuconazol<br \/>\n\u25a0 fluopiram + tebuconazol<br \/>\n\u25a0 fluoxastrobina<br \/>\n\u25a0 imidacloprida<br \/>\n\u25a0 penciur\u00e3o<br \/>\n\u25a0 espiroxamina<br \/>\n\u25a0 tebuconazol<br \/>\n\u25a0 triadimenol + triaz\u00f3xido<\/p>\n<p>Existem v\u00e1rias patentes para essas misturas e Certificados de Prote\u00e7\u00e3o Suplementar (SPCs) foram concedidos, estendendo a prote\u00e7\u00e3o de mercado para muito al\u00e9m do vencimento da patente do ingrediente ativo. O Diagrama 2 mostra o cronograma de data de expira\u00e7\u00e3o do SPC para protioconazol e misturas. A patente b\u00e1sica para o ai expira em 2015, mas os SPCs estendem isso at\u00e9 2018. Al\u00e9m disso, 11 produtos de mistura tamb\u00e9m t\u00eam prote\u00e7\u00e3o adicional de patente e SPC, estendendo a exclusividade de mercado entre 2019 e 2026.<\/p>\n<p>A Bayer apresentou uma solicita\u00e7\u00e3o em 2002 para o sistema de revis\u00e3o da UE para Novas Subst\u00e2ncias Ativas sob o Dir 91 \/414\/EEC. O dossi\u00ea foi declarado completo em 2003 e o protioconazol obteve aprova\u00e7\u00e3o do Anexo I em 1\u00ba de agosto de 2008, resultando em um per\u00edodo de prote\u00e7\u00e3o de dados de 10 anos a partir desta data.<\/p>\n<p>Direitos de Propriedade Intelectual (DPI) \u00e9 uma \u00e1rea muito complicada, est\u00e1 em constante mudan\u00e7a e requer aconselhamento especializado para que empresas n\u00e3o inventoras entendam onde as oportunidades podem estar. Com uma posi\u00e7\u00e3o t\u00e3o forte de patentes e prote\u00e7\u00e3o de dados na Europa, pode ser mais lucrativo no curto prazo se concentrar em mercados fora da UE, como Argentina, Austr\u00e1lia, Brasil, Canad\u00e1, Nova Zel\u00e2ndia, R\u00fassia, Ar\u00e1bia Saudita, Turquia, Ucr\u00e2nia e EUA.<\/p>\n<p>\u00c9 essencial que as empresas de marketing e manufatura se entendam melhor, re\u00fanam recursos e desenvolvam oportunidades em conjunto.
