Abaixo est\u00e1 uma vis\u00e3o geral de algumas das mudan\u00e7as propostas que t\u00eam o potencial de impactar a FIFRA e a agricultura dos EUA.<\/p>\n<p><em>Altera\u00e7\u00f5es nas defini\u00e7\u00f5es atuais e responsabilidades do servi\u00e7o:<\/em><\/p>\n<ul>\n<li><strong>Remo\u00e7\u00e3o de \u201csem refer\u00eancia ao poss\u00edvel impacto econ\u00f4mico e outro de tal determina\u00e7\u00e3o\u201d dos crit\u00e9rios de listagem:<\/strong> De acordo com a FIFRA, os pesticidas registrados pela EPA nos EUA \u201cgeralmente n\u00e3o causar\u00e3o efeitos adversos irracionais no meio ambiente\u201d. Embora a FIFRA reconhe\u00e7a os potenciais custos e benef\u00edcios econ\u00f4micos e sociais do uso de pesticidas, a atual ESA limita claramente o papel da economia ao exigir que o Secret\u00e1rio fa\u00e7a determina\u00e7\u00f5es \u201c<em>unicamente<\/em> com base nas melhores informa\u00e7\u00f5es cient\u00edficas e comerciais dispon\u00edveis sobre o status de uma esp\u00e9cie, sem refer\u00eancia a poss\u00edveis impactos econ\u00f4micos ou outros de tal determina\u00e7\u00e3o.\u201d Com a remo\u00e7\u00e3o proposta da declara\u00e7\u00e3o \u201csem refer\u00eancia a poss\u00edveis impactos econ\u00f4micos e outros de tal determina\u00e7\u00e3o\u201d da linguagem regulat\u00f3ria em <em><strong>Se\u00e7\u00e3o 4 da ESA, 50 CFR Parte 424<\/strong><\/em>, as determina\u00e7\u00f5es ainda seriam feitas somente com base em considera\u00e7\u00f5es biol\u00f3gicas; no entanto, com a nova linguagem, os impactos econ\u00f4micos e outros poderiam ser apresentados para revis\u00e3o p\u00fablica se garantidos caso a caso. Os Servi\u00e7os prop\u00f5em esclarecer em <strong><em>Se\u00e7\u00e3o 4 da ESA, 50 CFR Parte 424.12(b)<\/em><\/strong> que \u00e1reas <u>n\u00e3o<\/u> ocupadas por esp\u00e9cies listadas s\u00f3 ser\u00e3o designadas como habitat cr\u00edtico quando <u>ocupado<\/u> \u00e1reas s\u00e3o inadequadas para garantir a conserva\u00e7\u00e3o ou resultariam em conserva\u00e7\u00e3o menos eficiente. Os Servi\u00e7os definem conserva\u00e7\u00e3o eficiente como conserva\u00e7\u00e3o que \u00e9 eficaz, onde os conflitos sociais s\u00e3o minimizados e o custo da conserva\u00e7\u00e3o \u00e9 proporcional aos benef\u00edcios das esp\u00e9cies. No entanto, como outras disposi\u00e7\u00f5es, defini\u00e7\u00f5es subjacentes podem impactar o que \u00e9 considerado uma a\u00e7\u00e3o ben\u00e9fica e, portanto, como uma mudan\u00e7a nesta se\u00e7\u00e3o afetaria a agricultura.<\/li>\n<li><strong>Colabora\u00e7\u00e3o:<\/strong> Adi\u00e7\u00f5es propostas para <strong><em>Se\u00e7\u00e3o 7 da ESA, 50 CFR Parte 402.14(h)<\/em><\/strong> permitiria a colabora\u00e7\u00e3o entre a EPA, os Servi\u00e7os e o requerente. No caso de um registro de pesticida, o requerente \u00e9 o registrante (entidade que registra o pesticida), embora isso n\u00e3o esteja claramente definido nos regulamentos. Dependendo de como ou se a defini\u00e7\u00e3o do \u201crequerente\u201d for esclarecida, a participa\u00e7\u00e3o do registrante no desenvolvimento do \u201cpacote de inicia\u00e7\u00e3o\u201d e a contribui\u00e7\u00e3o para o processo e os resultados tamb\u00e9m podem ser afetados, esperan\u00e7osamente de forma positiva.<\/li>\n<\/ul>\n<p><em>Procedimentos para uma t\u00e9cnica de consulta opcional:<\/em><\/p>\n<ul>\n<li><strong>Consulta \u201cProgram\u00e1tica\u201d:<\/strong> As altera\u00e7\u00f5es propostas incluem a adi\u00e7\u00e3o da \u201cconsulta program\u00e1tica\u201d como t\u00e9cnica de consulta opcional em <strong><em>Se\u00e7\u00e3o 7 da ESA, 50 CFR Parte 402.14(c)(4)<\/em><\/strong>. Onde h\u00e1 a\u00e7\u00f5es m\u00faltiplas semelhantes e repetidas em um programa, regi\u00e3o ou outra base, a consulta program\u00e1tica aborda essas a\u00e7\u00f5es em uma revis\u00e3o abrangente. Se abordada de forma eficaz e estrat\u00e9gica, essa revis\u00e3o pode trazer previsibilidade e consist\u00eancia \u00e0s consultas sobre pesticidas, mas tamb\u00e9m pode haver consequ\u00eancias n\u00e3o intencionais. Conforme demonstrado pela recente <a href=\"https:\/\/www.regulations.gov\/document?D=EPA-HQ-OPP-2018-0141-0002\" target=\"_blank\" rel=\"noopener\">Parecer Biol\u00f3gico NMFS para organofosforados<\/a>, o processo de consulta para avalia\u00e7\u00e3o nacional de pesticidas n\u00e3o \u00e9 t\u00e3o direto ou previs\u00edvel quanto outras consultas que s\u00e3o limitadas em escopo. Por exemplo, um \u00fanico pesticida pode ser aplicado em v\u00e1rias culturas diferentes e \u00e1reas n\u00e3o cultivadas para o controle de v\u00e1rias pragas em uma grande \u00e1rea geogr\u00e1fica. A capacidade de abordar pesticidas programaticamente pode ser uma melhoria para a ind\u00fastria de pesticidas e agr\u00edcola se aumentar a efici\u00eancia e a previsibilidade. Alternativamente, a ind\u00fastria de pesticidas e agr\u00edcola pode ser impactada negativamente se a consulta program\u00e1tica for usada como um mecanismo para definir os termos e condi\u00e7\u00f5es para consultas de a\u00e7\u00e3o individual subsequentes, resultando na necessidade de camadas adicionais de consultas que seriam necess\u00e1rias entre a avalia\u00e7\u00e3o nacional e o uso local. Mecanismos de consulta alternativos podem abrir a porta para abordar a consulta de forma diferente do que no passado para a agricultura, como utilizar pr\u00e1ticas volunt\u00e1rias de conserva\u00e7\u00e3o e outras que evitem, minimizem ou compensem os efeitos dos pesticidas em esp\u00e9cies listadas. E, com as adi\u00e7\u00f5es propostas a <strong><em>Se\u00e7\u00e3o 7 da ESA, 50 CFR Parte 402.14(h)<\/em><\/strong>, se especificamente inclu\u00eddas no \u201cpacote de inicia\u00e7\u00e3o\u201d, quaisquer pr\u00e1ticas que se destinem a evitar, minimizar ou compensar os efeitos de um pesticida em esp\u00e9cies listadas poderiam ser formalmente adotadas pelos Servi\u00e7os e usadas para emitir uma licen\u00e7a ao abrigo <strong><em>Se\u00e7\u00e3o 10(a) da ESA<\/em><\/strong> (para proteger contra captura incidental (dano) de uma esp\u00e9cie). Para a ind\u00fastria agr\u00edcola, isso pode significar que medidas volunt\u00e1rias de conserva\u00e7\u00e3o acordadas pela EPA, ind\u00fastria e produtores podem ser incorporadas ao processo de consulta e consideradas na emiss\u00e3o de uma licen\u00e7a de captura pelos Servi\u00e7os. Alternativamente, medidas que podem n\u00e3o ter sido acordadas pela ind\u00fastria podem se tornar pr\u00e1ticas necess\u00e1rias, mesmo que sejam caras ou impratic\u00e1veis \u2014 uma rota que n\u00e3o seria favor\u00e1vel \u00e0 agricultura.<\/li>\n<\/ul>\n<p><em>Revis\u00f5es \u00e0 regra geral da se\u00e7\u00e3o 4(d):<\/em><\/p>\n<ul>\n<li>A ESA faz uma distin\u00e7\u00e3o entre listar uma esp\u00e9cie como \u201camea\u00e7ada\u201d ou \u201cem perigo\u201d, sendo \u201cem perigo\u201d uma necessidade de prote\u00e7\u00e3o mais urgente. <strong><em>ESA Se\u00e7\u00e3o 4(d), 50 CFR Parte 17<\/em><\/strong> da ESA, os Servi\u00e7os t\u00eam autoridade para redigir regras espec\u00edficas para cada esp\u00e9cie <u>amea\u00e7ado<\/u> esp\u00e9cies assumindo que as regras espec\u00edficas da esp\u00e9cie s\u00e3o necess\u00e1rias para a conserva\u00e7\u00e3o da esp\u00e9cie. Atualmente, o FWS aplica uma regra 4(d) \u201cgeral\u201d que essencialmente trata esp\u00e9cies amea\u00e7adas e em perigo de extin\u00e7\u00e3o como se fossem iguais perante a lei em termos de disposi\u00e7\u00f5es de captura. O NMFS, por outro lado, n\u00e3o usa uma regra 4(d) \u201cgeral\u201d e desenvolve regras 4(d) espec\u00edficas da esp\u00e9cie para esp\u00e9cies amea\u00e7adas. A mudan\u00e7a proposta alinhar\u00e1 a implementa\u00e7\u00e3o da Se\u00e7\u00e3o 4(d) entre o FWS e o NMFS e significar\u00e1 que o FWS desenvolver\u00e1 planos espec\u00edficos da esp\u00e9cie para cada esp\u00e9cie amea\u00e7ada quando for considerado necess\u00e1rio. O FWS solicita especificamente feedback sobre sua inten\u00e7\u00e3o de finalizar regras espec\u00edficas para esp\u00e9cies em conjunto com regras de listagem final, bem como se devem incluir linguagem vinculativa na regulamenta\u00e7\u00e3o, como definir um prazo para finalizar regras espec\u00edficas para esp\u00e9cies ap\u00f3s uma listagem final ou determina\u00e7\u00e3o de reclassifica\u00e7\u00e3o.<\/li>\n<\/ul>\n<p>Com todas as disposi\u00e7\u00f5es propostas, as mudan\u00e7as finais nos regulamentos e o impacto resultante na agricultura podem variar muito com base em como as defini\u00e7\u00f5es discutidas acima s\u00e3o alteradas, bem como em como as disposi\u00e7\u00f5es e defini\u00e7\u00f5es subjacentes s\u00e3o atualmente interpretadas.
