O conte\u00fado de carbono do solo est\u00e1 diminuindo por v\u00e1rios motivos, mas as Diretivas-Quadro de Nitrato, Emiss\u00e3o e \u00c1gua tamb\u00e9m desempenham um papel importante.<\/p>\n<p>O aumento do teor de carbono do solo pode ser alcan\u00e7ado usando materiais fertilizantes que s\u00e3o ricos em mat\u00e9ria org\u00e2nica. Tais materiais se originam em particular de esterco animal e materiais fertilizantes org\u00e2nicos. No entanto, esses materiais muitas vezes cont\u00eam uma mistura de oligoelementos desfavor\u00e1veis, dependendo dos pat\u00f3genos humanos de origem, bem como nutrientes ben\u00e9ficos. Todos estes s\u00e3o regulamentados sob v\u00e1rias legisla\u00e7\u00f5es em n\u00edvel horizontal da UE e, al\u00e9m disso, em n\u00edvel nacional e, \u00e0s vezes, at\u00e9 mesmo regional.<\/p>\n<p>Tr\u00eas pontos sugerem que as legisla\u00e7\u00f5es dificultam o aumento razo\u00e1vel do carbono no solo devido aos plat\u00f4s nutritivos ou aos chamados tetos, por exemplo, teto de N, teto de P e tetos para oligoelementos como Cu e Zn.<\/p>\n<p>Repensando o mundo regulat\u00f3rio e considerando o sequestro de carbono como uma meta importante para manter o solo saud\u00e1vel para a pr\u00f3xima gera\u00e7\u00e3o, sugere-se adicionar um novo tipo de fertilizante ao Regulamento de Produtos Fertilizantes da UE (UE) 2019\/1009 (FPR).<\/p>\n<p>O FPR regulamenta fertilizantes inorg\u00e2nicos e \u00e9 uma tentativa importante de tamb\u00e9m regulamentar fertilizantes org\u00e2nicos. A partir de meados de julho de 2022, fertilizantes org\u00e2nicos podem ser vendidos em toda a Uni\u00e3o Europeia se atenderem aos requisitos do FPR e ostentarem a Marca CE. Os Estados-Membros da UE n\u00e3o devem restringir um fertilizante com a marca CE. A obten\u00e7\u00e3o de uma marca CE depende, por exemplo, de crit\u00e9rios para conte\u00fado de nutrientes, fonte de material, seguran\u00e7a, pat\u00f3genos humanos, oligoelementos, etc. Para fertilizantes org\u00e2nicos, o conte\u00fado de carbono org\u00e2nico \u00e9 definido como um m\u00ednimo de pelo menos 3% at\u00e9 um m\u00ednimo de 15% para um PFC espec\u00edfico (Tabela 1).<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-67750\" src=\"https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a.jpg\" alt=\"\" width=\"912\" height=\"675\" srcset=\"https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a.jpg 912w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-300x222.jpg 300w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-768x568.jpg 768w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-16x12.jpg 16w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-330x244.jpg 330w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-97x72.jpg 97w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-486x360.jpg 486w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-778x576.jpg 778w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-85x63.jpg 85w, https:\/\/d6kq167ddwbdq.cloudfront.net\/farmchemint\/wp-content\/uploads\/2021\/08\/Table-1a-150x111.jpg 150w\" sizes=\"auto, (max-width: 912px) 100vw, 912px\" \/><\/p>\n<p>A legisla\u00e7\u00e3o da UE permite uma restaura\u00e7\u00e3o razo\u00e1vel do teor decrescente de carbono em nossos solos?<\/p>\n<p>Para aumentar o conte\u00fado de carbono do solo em 1% na camada superior de cultivo do solo de 30 cm, estima-se que cerca de 50 toneladas de mat\u00e9ria org\u00e2nica devem ser transmitidas. Fertilizantes org\u00e2nicos s\u00f3lidos devem conter um m\u00ednimo de 27% de mat\u00e9ria org\u00e2nica de acordo com o FPR (Tabela 1). Com base nisso, v\u00e1rias quantidades (por exemplo, &gt;100 t\/ha em teoria) de fertilizante org\u00e2nico fresco precisariam ser transmitidas. As legisla\u00e7\u00f5es da UE, bem como o FPR, permitem quantidades t\u00e3o grandes para medi\u00e7\u00f5es de corre\u00e7\u00e3o que poderiam aumentar seriamente o conte\u00fado de mat\u00e9ria org\u00e2nica e apoiar o sequestro de carbono do solo?<\/p>\n<p>O <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:31991L0676&amp;from=EN\" target=\"_blank\" rel=\"noopener\">Diretiva Nitratos (UE) 91\/676 (ND)<\/a> introduziu um limite de concentra\u00e7\u00e3o de nitrato de 50 mg\/L para \u00e1guas subterr\u00e2neas e superficiais. Este limite \u00e9 implementado em v\u00e1rias leis nacionais, planos de a\u00e7\u00e3o obrigat\u00f3rios e convertido em tetos de aplica\u00e7\u00e3o de fertilizantes que direcionam (ou restringem) a gest\u00e3o agr\u00edcola por cada estado-membro. Por exemplo, tetos de aplica\u00e7\u00e3o para N s\u00e3o definidos por cultura e por tipo de solo durante a esta\u00e7\u00e3o de crescimento em:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.rvo.nl\/sites\/default\/files\/2020\/02\/Tabel-2-Stikstof-landbouwgrond-2019-2021.pdf\" target=\"_blank\" rel=\"noopener\">Pa\u00edses Baixos<\/a> (por exemplo, batata de consumo: 96 \u2013 275 Kg N \/ ha ou trigo de inverno 160 \u2013 245 Kg N \/ ha)<\/li>\n<li><a href=\"https:\/\/www.vlm.be\/nl\/SiteCollectionDocuments\/Publicaties\/mestbank\/Bemestingsnormen_2021.pdf\" target=\"_blank\" rel=\"noopener\">B\u00e9lgica<\/a> (por exemplo, batatas: 163 \u2013 200 Kg N \/ ha ou trigo de inverno 136 \u2013 175 Kg N \/ ha).<\/li>\n<\/ul>\n<p>Al\u00e9m disso, um teto para esterco animal e produtos processados foi estabelecido em 170 Kg N\/ha. Desde ent\u00e3o, os agricultores come\u00e7aram a usar os tetos m\u00e1ximos de nitrog\u00eanio para alimentar a cultura que absolutamente precisava de N para maximizar o rendimento e evitar defici\u00eancias na cultura. A legisla\u00e7\u00e3o n\u00e3o permitiu mais que eles cuidassem do conte\u00fado de mat\u00e9ria org\u00e2nica ou do sequestro de carbono em seus solos.<\/p>\n<p>Em \u00e1reas com pecu\u00e1ria muito intensiva, tetos nacionais de fosfato foram introduzidos na legisla\u00e7\u00e3o em n\u00edvel regional. Na Holanda, B\u00e9lgica e outros pa\u00edses, tetos de fosfato foram colocados em pr\u00e1tica para evitar lixivia\u00e7\u00e3o para \u00e1guas subterr\u00e2neas e superficiais e traduzidos em taxas m\u00e1ximas de aplica\u00e7\u00e3o. Por exemplo, tetos de aplica\u00e7\u00e3o para fosfato:<\/p>\n<ul>\n<li>em <a href=\"https:\/\/www.rvo.nl\/onderwerpen\/agrarisch-ondernemen\/mest\/gebruiken-en-uitrijden\/hoeveel-fosfaat-landbouwgrond\/fosfaatdifferentiatie\" target=\"_blank\" rel=\"noopener\">Pa\u00edses Baixos<\/a> est\u00e3o fixados entre 40 \u2013 120 Kg P<sub>2<\/sub>O<sub>5<\/sub> \/ ha para culturas ar\u00e1veis, dependendo do teor de P no solo ap\u00f3s a amostragem;<\/li>\n<li>e em <a href=\"https:\/\/www.vlm.be\/nl\/SiteCollectionDocuments\/Publicaties\/mestbank\/Bemestingsnormen_2021.pdf\" target=\"_blank\" rel=\"noopener\">B\u00e9lgica<\/a> para batatas e trigo de inverno: 55 \u2013 95 Kg P<sub>2<\/sub>O<sub>5<\/sub> \/h\u00e1.<\/li>\n<\/ul>\n<p>No entanto, desde que esses tetos regionais foram implementados, os fazendeiros come\u00e7aram a usar o teto de P para alimentar a cultura que absolutamente precisava de P para maximizar o rendimento e evitar defici\u00eancias na cultura. Tamb\u00e9m aqui, a legisla\u00e7\u00e3o n\u00e3o permitiu que os fazendeiros cuidassem do conte\u00fado de mat\u00e9ria org\u00e2nica ou sequestro de carbono em seus solos.<\/p>\n<p>Outra fonte org\u00e2nica vem das esta\u00e7\u00f5es de tratamento de \u00e1guas residuais que produzem lodo de esgoto. <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:31986L0278&amp;from=EN\" target=\"_blank\" rel=\"noopener\">Diretiva de Lamas de Esgoto (UE) 86\/287 (SSD)<\/a> est\u00e1 atualmente em revis\u00e3o. Na Fran\u00e7a, o lodo de esgoto \u00e9 colocado em terras agr\u00edcolas para aumentar a mat\u00e9ria org\u00e2nica e fazer uso dos nutrientes dispon\u00edveis para o solo com base, por exemplo, em um plano de fertiliza\u00e7\u00e3o acordado com o local <a href=\"https:\/\/grandest.chambre-agriculture.fr\/agro-environnement\/valorisation-agricole-des-produits-organiques-et-mineraux-dorigines-urbaines-et-industrielles\/boues-industrielles\/\" target=\"_blank\" rel=\"noopener\">c\u00e2mara de agricultura<\/a>. A legisla\u00e7\u00e3o de res\u00edduos combinada com o SSD estabeleceu tetos para elementos tra\u00e7o e microelementos. No entanto, enquanto em um pa\u00eds Cu (de canos de \u00e1gua) e Zn (de calhas de telhado e sistemas de esgoto) s\u00e3o considerados micronutrientes ben\u00e9ficos, eles s\u00e3o considerados metais pesados em outros pa\u00edses e, portanto, n\u00e3o podem ser aplicados.<\/p>\n<p>Esses tr\u00eas pontos sugerem que a legisla\u00e7\u00e3o na UE e seus Estados-Membros dificultam o aumento razo\u00e1vel do carbono do solo devido aos limites estabelecidos para macronutrientes (N e P) e micronutrientes (Cu e Zn). Pode-se dizer que o FPR \u00e9 uma legisla\u00e7\u00e3o opcional, o que significa que o cumprimento desse requisito horizontal acontece de forma volunt\u00e1ria. No entanto, de uma perspectiva legal, outras legisla\u00e7\u00f5es de emiss\u00e3o derivadas da horizontal e traduzidas em leis nacionais com o estabelecimento de limites adicionais para aplica\u00e7\u00f5es de nutrientes e oligoelementos convertem os requisitos de opcionais para obrigat\u00f3rios.<\/p>\n<p>A fertiliza\u00e7\u00e3o org\u00e2nica em massa de cerca de 50 toneladas de mat\u00e9ria org\u00e2nica (por exemplo, &gt;100 t\/ha de produto fresco) para aumentar o sequestro de carbono n\u00e3o ser\u00e1 poss\u00edvel em muitos pa\u00edses porque isso resultaria em exceder o teto de N, teto de P, teto de micronutrientes ou tetos para outros oligoelementos.<\/p>\n<p>Repensar a estrutura regulat\u00f3ria e levar em considera\u00e7\u00e3o o sequestro de carbono como uma meta importante para manter o solo saud\u00e1vel para a pr\u00f3xima gera\u00e7\u00e3o pode exigir a inclus\u00e3o de um novo tipo de fertilizante no FPR definido como: Sequestro de
