U.S. Supreme Court Rules Trump’s IEEPA Tariffs ‘Not Legitimate Use of Power’
This morning the U.S. Supreme Court, in a 6 to 3 ruling, determined that President Donald Trump’s use of International Emergency Economic Powers Act (IEEPA) to impose sweeping tariffs on most of the U.S. trading partners was not a legitimate use of that authority.
The majority opinion is silent about refunds to those countries where tariffs were imposed. The minority opinion acknowledges that refunds would be difficult to achieve. Trump used IEEPA to impose the fentanyl, reciprocity, Russia oil and Brazil tariffs.
All other levies remain in place including 301 tariffs on China.
Fentanly tariffs were imposed on China, Canada and Mexico to curb fentanyl traffic and the chemicals used to create it in the U.S. in 2025 and this year.
In 2025, Trump put a 25%- 50% tariff on Indian goods for importing Russia oil. This year, Trump came to agreement with the Indian government to reduce the tariffs to 18% when they agreed to stop importing Russian oil.
Brazil tariffs, implemented on Aug. 1, 2025, included a 50% tariff on all Brazilian goods in for the criminal prosecution of former Brazilian President Jair Bolsonaro.
