Syngenta Wins Monsanto Corn Patent Dispute

The suit accused Syngenta of using seed purchased from Monsanto licensees in order to create seeds that can thrive in fields where glyphosate is concurrently used. Syngenta had acquired Garst Seed Co. and Golden Harvest Seeds Inc., both of which are licensed to sell resistant corn.  The appeals court upheld the lower court ruling that Syngenta had legally obtained the seeds through these acquisitions. In a 16-page ruling, the court stated, “Upon obtaining the seeds, Syngenta also acquired the right to further produce GA21 progenies containing the glyphosate resistance trait.”

Syngenta sells the corn under the name “Agrisure GT.” Monsanto’s Roundup corn offers similar resistance.
